3. User Obligations
The user must at all times respect the terms and conditions established in these general conditions of use of the portal. The user expressly states that he will diligently use the portal and assume any responsibility that could arise from breach of the rules.
Likewise the user can not use the portal to transmit, store, disclose, promote or distribute data or contents that carry viruses or any other computer code, files or programs designed to interrupt, destroy, harm or damage the functioning of any computer or telecommunication software or hardware.
4. Portal Responsibility
The user acknowledges and accepts that the portal does not grant any guarantee of any nature, express or implied, about the data, contents, information and services that are incorporated and offered by the Portal.
Except where the law expressly states otherwise, and exclusively with the measure and extent that it imposes, the Portal does not guarantee or assume liability for any harm or damages caused by the use of information, data and services of the Portal.
In any case, the Portal excludes any liability for damages that may be due to information and/or services provided or supplied by third parties other than the Company. All responsibility will be with the third party, either supplier or collaborator.
5. Intellectual and industrial property
All contents, trademarks, logos, drawings, documentation, computer programs or any other element susceptible of protection by the legislation of intellectual or industrial property, that are accessible in the portal correspond exclusively to the company or its legitimate owners who expressly reserve all the rights over them.
It is expressly prohibited to create hypertext links to any element of the Portal’s web pages without the authorization of the company, provided they are not to a web page of the Portal that does not require identification or authentication for access, or is restricted.
In any case, the portal reserves all rights over the contents, information, data and services provided. The portal does not grant any license or authorization to use to the user on its contents, data or services, other than that expressly detailed in these general conditions of use of the portal.
6. Applicable legislation, jurisdiction and notifications
The present conditions are governed and interpreted according to the Laws of Spain. For any claim the courts and tribunals of Malaga will be competent. All notices, citations, requests and other communications that the user wishes to make to the company that owns or manages the portal must be made in writing.
